1. Acceptance of Terms

By downloading, installing, or using the Device to Cloud Manager application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms form a legally binding agreement between you (“User”) and Yantra Cloud Ltd (“we”, “us”, or “our”), a company registered in Scotland.

2. Description of the Service

Device to Cloud Manager is a mobile/desktop application that enables users to manage their data stored on Google Cloud Platform (GCP) directly from their own device. The App:

  • Connects directly from your device to GCP APIs using credentials you provide.
  • Does not route data through Yantra Cloud Ltd servers.
  • Does not store any user data or credentials on Yantra Cloud Ltd’s infrastructure.
  • Is hosted and distributed from infrastructure within the European Union (EU).

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement and that your use of the App does not violate any applicable law or regulation.

4. Your Google Cloud Platform Account

The App facilitates access to your own GCP account. To use the App:

  • You must have a valid Google Cloud Platform account.
  • You are solely responsible for all activity that occurs under your GCP account, including any actions taken through the App.
  • You must comply with Google’s Terms of Service and applicable GCP policies.
  • You are responsible for maintaining the security of your GCP credentials on your device.

5. No Server-Side Data Storage

Yantra Cloud Ltd does not store, process, or have access to:

  • Your GCP credentials, API keys, tokens, or service account files.
  • Any data you store in or retrieve from GCP.
  • Any personal information relating to your GCP account or its contents.

All such data remains exclusively on your device. You are solely responsible for securing your device and the data stored on it.

6. Acceptable Use

You agree not to use the App to:

  • Violate any applicable local, national, or international law or regulation.
  • Gain unauthorised access to any GCP account other than your own.
  • Infringe the intellectual property rights of any third party.
  • Engage in any conduct that restricts or inhibits anyone’s use or enjoyment of the App.
  • Introduce malicious software or attempt to circumvent security measures.

7. Intellectual Property

The App, including its design, code, and documentation, is the intellectual property of Yantra Cloud Ltd and is protected by applicable copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal or internal business purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the App, nor reverse-engineer or attempt to extract the source code, without our written permission.

8. Disclaimer of Warranties

The App is provided “as is” and “as available”, without warranty of any kind. To the extent permitted by applicable law, Yantra Cloud Ltd expressly disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The App will function uninterrupted or error-free.
  • Defects will be corrected.
  • The App or the servers from which it is distributed are free of viruses or other harmful components.

9. Limitation of Liability

To the maximum extent permitted by law, Yantra Cloud Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from or relating to:

  • Your use of or inability to use the App.
  • Any unauthorised access to or alteration of your data.
  • Any errors, interruptions, or loss of data in connection with GCP services.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

10. Third-Party Services

The App interacts with Google Cloud Platform, a service provided by Google LLC. Your use of GCP through the App is subject to Google’s own terms of service and privacy policies. Yantra Cloud Ltd is not responsible for the availability, accuracy, or content of any third-party services, including GCP.

11. Changes to the App or Terms

We reserve the right to modify or discontinue the App (or any feature thereof) at any time, with or without notice. We may also update these Terms from time to time. Continued use of the App following any changes constitutes your acceptance of the revised Terms.

12. Termination

We may suspend or terminate your access to the App at our discretion, without notice, if we reasonably believe you have breached these Terms. You may stop using the App at any time by uninstalling it from your device.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Scotland and, where applicable, the laws of the United Kingdom. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Scotland.

Where applicable, EU consumers may also rely on the mandatory consumer protection provisions of their country of residence.
